Referral Programme Terms and Conditions

By participating in the Fella Health Referral Program ("Program"), you agree to be bound by these terms and conditions ("Terms"). Please read them carefully.

1. Program Overview

The Fella Health Referral Program allows existing customers to earn rewards by referring new customers to our services. Participants ("Referrers") can earn £20 coupons when successfully referred friends ("Referees") make qualifying purchases.

2. Eligibility

2.1 Referrer Eligibility:

• Must be an existing Fella Health customer with at least one completed order
• Must be 18 years or older
• Must have a valid UK address
• Account must be in good standing with no outstanding disputes or violations
• Must not be engaged in affiliate marketing, influencer marketing, or any commercial promotional activities
• Must refer only personal contacts with whom they have a genuine personal relationship

2.2 Referee Eligibility:

• Must be a new customer who has never placed an order with Fella Health
• Must be 18 years or older
• Must have a valid UK address
• Is approved for prescription medication by Fella Health clinicians

3. How the Program Works

3.1 Referral Process:

• Referrers receive a unique referral link through their account
• Referees must click the referral link as their final referral source and complete their first purchase
• If a referee clicks multiple referral links, only the last-clicked link will be credited
• Referees receive £35 off their first qualifying purchase

3.2 Reward Distribution:

• Referrers receive a £20 coupon 7 days after the referee's order is placed, provided the referee has not been refunded for their order
• If the Referee’s order cannot be fulfilled for any reason, the order is not eligible for commission
• Coupons are valid for 12 months from issue date
• Multiple £20 coupons may be used per order (coupons can stack)
• Coupons are non-transferable and tied to the Referrer's registered email address

4. Restrictions and Limitations

4.1 Usage Limits:

• No maximum limit on referrals, but each referee can only be referred once
• Referrers cannot refer themselves using different accounts or identities
• Corporate or bulk referrals are prohibited

4.2 Sharing Guidelines:

• Referral links may only be shared privately with individuals known personally to the Referrer
• Public posting of referral links on social media, forums, or websites is strictly prohibited
• Referrers must not mention specific prescription medication names in referral communications
• Referrers must not provide medical advice or discuss medication dosages/side effects

4.3 Prohibited Activities:

• Using automated systems, bots, or scripts to generate referrals
• Creating fake accounts or using false information
• Engaging in spam or unsolicited marketing
• Violating advertising standards for prescription medicines (MHRA guidelines)
• Purchasing advertising space to promote referral links
• Offering additional incentives beyond the program rewards
• Operating as an affiliate marketer, influencer, or professional promoter to generate referral conversions
• Using referral links as part of any commercial or income-generating activity
• Promoting referral links through paid advertising, sponsored content, or marketing campaigns
• Referring individuals with whom you do not have a genuine personal relationship
• Systematic or mass distribution of referral links
• Creating content primarily designed to drive referral conversions

5. Medical and Legal Compliance

5.1 Prescription Medicine Advertising:

• All referral activities must comply with MHRA (Medicines and Healthcare products Regulatory Agency) guidelines
• Referrers cannot advertise prescription medicines to the general public
• Personal experience sharing is permitted but must not encourage specific medical treatment-seeking behaviour

5.2 Data Protection:

• Referrers must only share links with individuals who have consented to receive them
• Personal data must be handled in accordance with GDPR and our Privacy Policy
• Referrers acknowledge that all customer information is confidential and protected under data protection legislation. Fella Health will not disclose any details regarding referee orders, consultations, prescriptions, or personal information to referrers, except for confirmation of qualifying purchase completion for reward purposes.

6. Disqualification and Violations

6.1 Immediate Disqualification:Fella Health reserves the right to immediately disqualify participants and void rewards for:

• Fraudulent activity or misrepresentation
• Violating advertising standards for prescription medicines
• Spam or aggressive marketing tactics
• Creating multiple accounts to circumvent program rules
• Any activity deemed harmful to Fella Health's reputation or operations
• Commercial use of referral links or operating as an affiliate/influencer marketer
• Systematic referral generation or treating the program as a business opportunity
• Referring individuals without genuine personal relationships
• Using referral links in conjunction with paid advertising or promotional campaigns

6.2 Investigation Process:

• Fella Health may investigate suspicious referral activity
• Participants must cooperate with investigations and provide requested information
• Decisions regarding violations are final and at Fella Health's sole discretion

7. Modifications and Termination

7.1 Program Changes:

• Fella Health may modify these Terms, reward amounts, or program structure at any time
• Changes will be communicated via email and posted on our website with reasonable advance notice
• Outstanding rewards earned but not yet due for payment may be subject to modified terms, including changes to reward amounts, expiration dates, or redemption conditions
• Continued participation constitutes acceptance of modified Terms

7.2 Program Termination:

• Fella Health may suspend or terminate the Program at any time without prior notice
• Outstanding rewards earned before termination will be honoured
• No compensation is owed for future potential earnings

8. Coupon Terms

8.1 Coupon Validity:

• Coupons expire 12 months from issue date
• Coupons have no cash value and cannot be exchanged for cash
• Coupons are void if transferred, sold, or duplicated
• Only one coupon may be applied per order

8.2 Coupon Restrictions:

• Cannot be combined with other promotional offers unless explicitly stated
• Cannot be applied to delivery charges, taxes, or fees
• Cannot be used for prescription consultation fees
• Must be applied at checkout during your medication reorder through your Dashboard at app.fellahealth.co.uk
• Cannot be retroactively applied or used on the regular sales pages outside the patient Dashboard

9. Order Validation and Refunds

9.1 Qualifying Orders:

• Referee orders must be completed and delivered to qualify
• Orders cancelled before dispatch do not qualify for rewards

9.2 Refund Impact:

• If a referee's order is fully or partially refunded, associated referral rewards are void
• Referrers must return any coupons received for refunded referral orders
• Fella Health may deduct refunded rewards from future orders

10. Technical Issues

10.1 Tracking Problems:

• Referral links must be used correctly for proper tracking
• Technical failures in tracking do not guarantee reward payment
• Fella Health will investigate tracking issues but decisions are final

10.2 System Limitations:

• Program availability subject to technical system functionality
• Fella Health is not liable for technical failures preventing participation

11. Liability and Disclaimers

11.1 Limited Liability:

• Fella Health's liability is limited to the value of earned but unpaid rewards
• No liability for indirect, consequential, or punitive damages
• Program participation is at participant's own risk

11.2 Indemnification:

• Participants indemnify Fella Health against claims arising from their referral activities
• This includes regulatory violations or misrepresentation in referral communications

12. General Provisions

12.1 Governing Law:

• These Terms are governed by English and Welsh law
• Any disputes subject to exclusive jurisdiction of English and Welsh courts

12.2 Severability:

• If any provision is deemed invalid, remaining provisions remain in full effect
• Invalid provisions will be replaced with enforceable equivalents where possible

12.3 Entire Agreement:

• These Terms constitute the complete agreement regarding the referral program
• Supersedes all prior communications or agreements regarding referrals

13. Definitions

• "Fella Health," "we," "us," "our": Fella Health Ltd and its affiliates
• "Customer": Any individual who has registered an account with Fella Health
• "Order": A completed purchase transaction for products or services
• "Qualifying Purchase": An order meeting minimum value and eligibility requirements
• "Referral Link": Unique tracking URL generated for each Referrer
• "Referrer": An existing Fella Health customer who shares their referral link with others
• "Referee": A new customer who uses a referral link to make their first purchase with Fella Health

By participating in the Fella Health Referral Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
